TERMS AND CONDITIONS OF SALE AND USE

ARTICLE 1. GENERAL INFORMATION

  • These terms and conditions of sale and use of the company Productions Jacques Canetti define the rights and responsibilities of the parties for the sale of items by the latter to Customers and the use of the website jacques-canetti.com (herein after, the “site”). The Customer hereby declares that he/she is aware of and accepts these rights and responsibilities.
  • The company Productions Jacques Canetti is a limited company under French law with capital of € 75 000 and whose head office is located at 19, Rue de la Cerisaie – 92150 Suresnes and is registered at the Nanterre Registrar of Companies under the number 552 035 578. 

ARTICLE 2. PRICE 

2.1.          The prices shown on the website www.jacques-canetti.com are in Euros inclusive of all French taxes (VAT + other taxes including tax on videos), not including the cost of handling and shipment. The prices of books and sheet music have been set with the strictest respect for the Lang law 81-766 of 10th August 1981.

2.2.          For orders to be shipped to a country other than mainland France, the Customer is deemed to be the importer of the items in question. For all products shipped outside the European Union and French DOM-TOM’s, the price is calculated excluding taxes. The rates, other local taxes, import duties and state taxes may be payable. These duties and taxes fall outside the jurisdiction of the company Productions Jacques Canetti. They are payable by the Customer and are their full responsibility, both in terms of declarations and payments to the authorities and relevant bodies. Customers are advised to contact their local authorities.

2.3.          The company Productions Jacques Canetti reserves the right to modify its prices at any time. The item will nevertheless be charged on the basis of the rates in effect at the time that the order was received.

2.4.          The items remain the property of the company Productions Jacques Canetti until full payment has been made.

ARTICLE 3. ORDER

Orders may be placed:

  • By telephone, on 01 42 04 97 05 from mainland France or on +33 1 42 04 97 05 from DOM-TOM’s and abroad, from Monday to Friday, 9:30 am to 6 pm.

ARTICLE 4. CONFIRMATION

4.1.          The Customer declares that they have read and accepted these terms and conditions of sale before placing their order. Confirmation of the order means that these terms and conditions of sale have been accepted.

4.2.          Unless proven otherwise, the information received by the company Productions Jacques Canetti, such as input into the website, constitutes proof that the transaction has been completed with the Customer.

ARTICLE 5. AVAILABILITY

5.1.          The items and prices stipulated on the website are valid for as long as they are visible on the website and as long as stocks remain available.

5.2.          For items not held in stock in the warehouses of the company Productions Jacques Canetti, supply is subject to availability from the suppliers in question.

5.3.          If an item should be unavailable after the order has been placed, the Customer will be informed by e-mail or by post as soon as the information is received from the suppliers in question. The order will be cancelled automatically.

ARTICLE 6. SHIPPING 

6.1.          The items are delivered to the delivery address given by the Customer during the ordering process. The lead times indicated on the website are the normal average lead times and correspond to the lead times for shipping and transport. For payments made by cheque, the lead times applicable start on the day that the cheque is received.

6.2.          In case of difficulty, the Customer is invited to contact the company Productions Jacques Canetti by e-mail on productions@canetti.com or by telephone on 01 42 04 97 05.

6.3.          In cases of late shipment an e-mail will be sent to the Customer. Should this occur, and as long as the product has not been shipped, the Customer shall have the right to cancel their order.

6.4.          After shipment, the company Productions Jacques Canetti may not be held responsible for the consequences of late shipment. The Customer may nevertheless cancel their order and ask for reimbursement of the item and the cost of return shipment, providing that the complete item, in its original state and packaging is immediately returned.

ARTICLE 7. LEAD TIMES AND SHIPPING COSTS 

7.1.          Shipping in mainland France and the European Union

All packages are sent by recorded delivery with a return receipt (except for the shipping of sheet music). The lead time (shipping time + transit time) is estimated at 72 hours for France and approximately 6 days for the European Union. The shipping costs are automatically calculated during the final confirmation of a purchase according to the total weight and destination of the package.

7.2.          Shipping to DOM-TOM’S or international

All shipping to DOM-TOM’S is done by Colissimo and abroad by Chronopost International. After confirmation of the order, the company Productions Jacques Canetti will send an e-mail to the Customer to inform them of the exact amount to be paid, inclusive of shipping. The shipping costs are also calculated according to the weight and the destination of the package.

Lead times for shipping are estimated at approximately one week. To ensure that shipping is done as quickly as possible, it is compulsory to indicate, when placing an order, the name and telephone number of the recipient. It is also highly recommended to not send packages to PO boxes (possible only in the DOM’s and TOM’s under certain conditions) or to general delivery abroad (excluding DOM’s).

ARTICLE 8. PAYMENT

The settlement of purchases can be carried out by:

  • credit card (Visa, MasterCard and other credit cards); the card will be debited when the order is shipped.
  • or by a banker’s cheque issued by a bank in mainland France or in Monaco only and payable to Productions Jacques Canetti. The cheque is cashed upon receipt. ARTICLE 9. SECURITY

The website is covered by a security system (http://www.paiementcic.com/). The SSL encryption process is applied and the whole process of scrambling and encryption is strengthened to protect all sensitive data related to the payment as efficiently as possible.

ARTICLE 10. SATISFIED OR YOUR MONEY BACK

10.1.       The Customer has a period of 15 days, starting from the receipt of the package, to return any item that does not meet with their satisfaction. The cost of return shipping is the Customer’s responsibility; only the price of the purchased item(s) will be reimbursed.

10.2.       Returned items are to be sent to PRODUCTIONS JACQUES CANETTI – Sales Department – 19, Rue de la Cerisaie – 92150, Suresnes, France in their original and complete state, accompanied by a copy of the bill. Items returned without cellophane / or incomplete and/or ruined and/or damaged and/or soiled are not returnable.

10.3.       Only faulty items will be exchanged for identical items.

ARTICLE 11. PRODUCT CONFORMITY

11.1.       The company Productions Jacques Canetti agrees to refund the Customer or exchange the faulty, spoiled or damaged item(s) that do not correspond to the Customer’s order. The Customer must make a written request indicating their exact reasons and return the item(s) to the company Productions Jacques Canetti, which will proceed with the exchange or reimbursement of the item(s) in question. The request must be made within 15 days of delivery. Any complaint made after this deadline will not be accepted.

11.2.       The shipping and return costs will be refunded to the Customer.

11.3.       In any event, the customer benefits from the provisions of the statutory warranty, including those conditions relating to hidden defects.

ARTICLE 12. REIMBURSEMENT  

12.1.       The refund of items covered by the terms of ARTICLE 10 and ARTICLE 11 above will be carried out within an approximate period of 15 days following the return of the items.

12.2.       The refund will be made either by a credit to the Customer’s bank account or by a cheque, in the Customer’s name, addressed to the billing address given when placing the order, depending on the choice made by the company Productions Jacques Canetti. Nothing sent for counter-refunding will be accepted for any reason whatsoever.

ARTICLE 13. CUSTOMER SERVICE

The customer service department of the company Productions Jacques Canetti is open Monday to Friday, from 9:30 am to 6pm.

ARTICLE 14. INTELLECTUAL PROPERTY 

Any reproduction, complete or partial, of the website or its contents is strictly forbidden.

ARTICLE 15. LIABILITY

15.1.       The items proposed for sale on the website comply with current French legislation. The company Productions Jacques Canetti may not be held liable for failure to comply with the laws of the country where the items are delivered (e.g. in case of the title being banned…). It is the Customer’s responsibility to check with the local authorities as to the importation or use of items or services that they wish to order.

15.2.       The company Productions Jacques Canetti will not be held liable for damage of any kind, whether tangible, intangible or material, which may result from the malfunction or poor use of the items sold. The same applies to any possible changes made to the items by suppliers.

15.3.       The liability of the company Productions Jacques Canetti will be, in any event, limited to the cost of the order and may not be challenged for simple errors or omissions, which could have occurred despite all due precautions taken when presenting the products.

15.4.       The company Productions Jacques Canetti will not be held liable towards a Customer or third party, for any indirect damage, or loss of business, profit or turnover, occurring in any way, even if this damage or loss or prejudice could have been foreseen by the company Productions Jacques Canetti, or if its occurrence had been brought to said company’s attention.

15.5.       Notwithstanding the preceding paragraphs, the liability of the company Productions Jacques Canetti in terms of these terms and conditions may not exceed an amount equal to the amounts paid or payable during the transaction that is at the origin of said liability, whatever the cause or form of the action involved.

15.6.       The company Productions Jacques Canetti will not be held liable for any breach of contract in the case of an item being out of stock or unavailable, for cases of force majeure, public disorder, total or partial strikes notably in the postal service and transportation services and / or communications, flood and fire.

15.7.       The photographs of the items are communicated for illustrative purposes only and are not contractual. The Customers are advised to read the description of each item in order to discover its precise characteristics. In case of doubt or for any additional information, please contact customer services.

ARTICLE 16. APPLICABLE LAW – DISPUTES

This contract is subject to French law. In case of dispute the French courts shall have jurisdiction.

ARTICLE 17. PERSONAL DATA

The information and data concerning Customers, such as collected on the website, are necessary for the management of orders and for commercial relations between Customers and the company Productions Jacques Canetti. They may be transmitted to companies that contribute to these relations, such as those in charge of the execution of services and orders, for their management, execution, processing and payment. These data are also kept for security reasons and to respect legal and regulatory obligations and the information addressed to Customers.

In accordance with the data protection act of the 6th January 1978, Customers have the right to access and modify their personal data, which they can exercise by sending an e-mail to productions@canetti.com or by writing to PRODUCTIONS JACQUES CANETTI – Sales Department – 19, Rue de la Cerisaie 92150, Suresnes, France indicating their full name, e-mail and postal address.
